A general action for judicial review of environmental agency decisions?

Since 2012, the general opinion in Chile is that the Legislative has established in Article 17 No. 8 of the Law No. 20,600 a new general action to review any environmental agency action. This paper contends this idea, claiming that Law No. 20,600 only vested environmental courts with jurisdiction involving that type of actions, but this action has not yet been established. Therefore, potential claimants only could bring it only when the Legislative Branch regulates all its procedural aspects. Actually, the hesitant Supreme Court’s decisions in the last few months is a clear proof of that statement.
