Verkenning van mogelijke wijzigingen in de Meststoffenwet door implementatie van verordening (EU) nr. 2019/1009 : Opties voor nationale bepalingen voor vrij handelsverkeer

Regulation (EU) 2019/1009 on the making available on the market of EU fertilising products came into force on 16 July 2022. The Netherlands has to implement this Regulation, which requires amending the Fertilisers Act. The current Fertilisers Act lists a large number of fertilising products that do not fall under the new European Regulation or which do not meet the criteria in this Regulation. This study explored a number of options for dealing with these fertilising products following the amendment of the Fertilisers Act. On 16 July 2022 the new EU Regulation was incorporated in full into the Fertilisers Act, but a temporary arrangement applies that leaves current provisions for national fertilising products and categories unchanged. These provisions will be amended in due course. This study presents five options for revising the national categories of fertilising products, ranging from leaving the national provisions as they are to dropping the national provisions altogether. The effects of these options were evaluated against the criteria of the Business Impact Assessment. The five options were evaluated for each national fertiliser category. The evaluation leads to recommendations for amending provisions on the free trade in fertilising products that are not regulated under Regulation (EU) 2019/1009.
