Pacta Tertiis and the Agreement for the Implementation of the Provisions of the United Nations Convention on the Law of the Sea of 10 December 1982 relating to the Conservation and Management of Straddling Fish Stocks and Highly Migratory Fish Stocks

<i>Pacta tertiis</i> is a rather cryptic description of a basic rule of customary international law which dates back to Roman law, and which reads in full <i>pacta tertiis nec nocent nec prosunt</i>. With respect to treaty law, this rule was codified in the Convention on the Law of Treaties of 1969, which states that treaties do not “create either obligations or rights for a third State without its consent”. This rule seems to be generally accepted today.
