Social Responsibility and its Development in Colombia

This presentation picks up on the United Nations Framework on Business and Human Rights as an axis for reflection on the challenges and critical issues for the sector, facing the construction of the social license to operate. From this perspective, both the social license and due diligence are critical for the sustainability of business operations. There are a growing number of stakeholders that have expectations regarding the companies and their interaction with the environment. These expectations are reflected in the way Corporate Social Responsibility (CSR) is conceived, what issues are raised by the companies, and how they address them. In complex environments such as the Colombian, human rights work becomes crucial for companies, because its omission or neglect can even block a transaction, receiving a loan, or the sale of the company’s shares on the stock market. Therefore, the concept of social license to operate becomes essential, mainly regarding the company’s key activities. The social license to operate is equally or more important than the legal license, since the sustainability of the operation depends on it. In that sense, the concept of due diligence is very useful because it allows many of the human rights concepts to become real. Due diligence involves maintaining continuous cycles of risk identification, impacts of company actions, development of management plans, review, assessment and permanent adjustments.

Esta presentación retoma el Marco de Naciones Unidas sobre Empresas y Derechos Humanos como eje para la reflexión sobre los retos y aspectos críticos para el sector, de cara a la construcción de la licencia social para operar. Bajo esta perspectiva, tanto la licencia social como la debida diligencia resultan críticas para la sostenibilidad de las operaciones empresariales. Hay un creciente número de grupos de interés que tienen expectativas respecto a las empresas y a su interacción con el entorno. Esas expectativas se traducen en la forma como se concibe la Responsabilidad Social Empresarial (RSE), cuáles son los temas que plantean las empresas y cuál es su manera de abordarlos. En entornos complejos como el colombiano, el trabajo en derechos humanos se vuelve fundamental para las empresas, porque su omisión o descuido puede incluso llegar a bloquear una operación, la recepción de un préstamo, o la venta de acciones de la empresa en la bolsa. Por lo anterior, el concepto de licencia social para operar se vuelve clave, en especial respecto a las actividades clave de la empresa. La licencia social para operar es tan o más importante que la licencia legal, pues de ella depende la sostenibilidad de la operación. En ese sentido el concepto de debida diligencia resulta muy útil, porque permite volver concretos muchos de los conceptos de derechos humanos. La debida diligencia implica mantener ciclos continuos de identificación de riesgos, impactos de las acciones de la empresa, elaboración de planes de manejo, revisión, evaluación y ajustes permanentes.
