Tratado minero entre Chile y Argentina : una visión global
The Mining Integration and Complementation Treaty between Chile and Argentina, was signed in 1997, and it’s Complementary Protocol of 1999, entered into force in 2000. Its provisions give rise to a new framework for the development of mining activities in neighboring border areas, and establish a special arrangement for the operation of mining projects that have projections in both countries. Among the fundamental principles of this Agreement, stand out that of national treatment within the scope of application for investors of origin of the other Party, the creation of an area of operations across the border, which requires Additional Specific Protocols, the possibility to establish transnational easements and the possibility of accessing natural resources in the other country. The Mining Treaty constitutes an economic instrument, at the same time that it creates the legal bases for cross-border mining.
